1. The Cabaïa Commercial Guarantee contract

Since product quality and customer satisfaction are Cabaïa's top priorities, the "Cabaïa Commercial Guarantee" allows you to benefit in certain cases from a repair or replacement of defective items under the conditions defined below.

The Cabaïa Commercial Guarantee is in addition to the legal guarantees of conformity and hidden defects, the validity of which is not affected by the present Cabaïa Commercial Guarantee.

Who provides the Cabaïa Commercial Guarantee?

The Cabaïa Commercial Guarantee is granted to you by VALTEX, a simplified joint stock company with a capital of 29,537.60 euros, having its registered office at 7 cité Paradis in Paris (75010), registered in the Paris Trade and Companies Register under number 813 603 347, intra-community VAT number: FR23813603347 email: contact@cabaia.fr ("VALTEX").

VALTEX guarantees the products purchased on the website cabaia.com and in the stores operated by VALTEX or by independent affiliates members of the Cabaïa network which are located at the following addresses :

Who can benefit from the Cabaïa Commercial Guarantee?

The Cabaïa Commercial Guarantee benefits natural persons who demonstrate ownership of a Cabaïa product covered by the Cabaïa Commercial Guarantee:

Either for having been the first purchaser from VALTEX or from an affiliated store member of the Cabaïa network, or to have been the first beneficiary in the case of a gift. Proof of these qualities can be provided by producing the defective product and its proof of purchase (sales receipt, order confirmation) as well as the identification code appearing inside the product.

How long can a person invoke the Cabaïa Commercial Guarantee?

As soon as you notice a defect on a product marketed by VALTEX, it is advisable to inform the latter according to the methods described below.

The Commercial Guarantee is granted for life.

What are the terms and conditions of the Cabaïa Commercial Guarantee?

If the product was purchased on the website cabaia.com:

To implement the Cabaïa Commercial Guarantee, you must first send your claim via the following questionnaire: contact questionnaire, indicating your order number and enclosing photographs, explanations and any other element that may demonstrate the alleged defect.

Thanks to these elements, Cabaïa's services will be able to establish an initial diagnosis and indicate whether the damage observed falls within the scope of the Cabaïa Commercial Guarantee or not.

If, after this initial diagnosis, the conditions for implementing the Cabaïa Commercial Guarantee appear to be met, Cabaïa will send you a product return form which you should fill in. On receipt of the product, Cabaïa will carry out a thorough check to verify whether the conditions of the Cabaïa Commercial Guarantee have been met. If the Cabaïa Commercial Guarantee is applicable, we will inform you whether the product is eligible for repair or replacement. If the product in question must be replaced and no identical product is available, Cabaïa will offer to replace it with an equivalent or similar product.

Products must be returned in accordance with Cabaïa's instructions. Shipping costs for the return of products not authorized by Cabaïa will be charged to you, unless Cabaïa agrees to pay for them.

For a purchase made in a Cabaïa boutique operated by VALTEX or an affiliate member of the Cabaïa network:

If you purchased your product in a store operated by VALTEX or an affiliate member of the Cabaïa network, you must register on the site guarantee.cabaia.com , in order to activate your Cabaia Commercial Guarantee. You will have to fill in: your first and last name, a valid email address, as well as the identification code of your product which can be found on the label inside it.

We invite you to visit a Cabaïa store operated by VALTEX or an independent affiliate with your proof of purchase and the product in question. An initial examination of the product will then be carried out to ensure that the conditions of the Cabaïa Commercial Guarantee are met. If, after this initial examination, the conditions of the Cabaïa Commercial Guarantee appear to have been met, the Cabaïa store concerned will take charge of returning the product to Cabaïa, it being specified that you will not bear the cost of returning the product.

Upon receipt of the product, we will carry out a thorough check to verify whether the conditions of the Cabaïa Commercial Guarantee have been met. If the Cabaïa Commercial Guarantee is applicable, we will inform you whether the product is eligible for repair or replacement. If the product in question must be replaced and no identical product is available, Cabaïa will offer to replace it with an equivalent or similar product.

For a purchase from a physical retailer or a website other than cabaia.com :
VALTEX does not process complaints concerning products sold by physical or internet retailers not bearing the Cabaïa brand name and not operated by VALTEX or a Cabaïa affiliate. We invite you to contact the retailer where you made your purchase with your original purchase invoice and the product, to determine with him whether he intends to offer a commercial guarantee. Our customer service will not process purchases made from resellers and sites other than the website cabaia.com.

How much does the Cabaïa Commercial Guarantee cost

The Cabaïa Commercial Guarantee is included in the purchase price of the product concerned: there is no additional charge for it!

What defects are covered by the Cabaïa Commercial Guarantee?

The Cabaïa Commercial Guarantee covers only the defects listed exhaustively below - to the exclusion of all other defects.

Defects in the seams :
Top of the strap torn / detached
Backpack seams that loosen
Zip seams that come undone
Tearing seams

The following defects related to the buckles and inner pockets :
Torn pockets
Broken curls
Broken zipper pull
Insufficient fabric length (fabric with a hole at the seam)
Defective pressure button
Broken elastic

The following are not covered by the Cabaïa Commercial Guarantee :
Cutting / tearing in the fabric
Tache
Damaged fabric
Discolored / faded fabric
Burns
Damaged or worn backpack bottom
Scratch(s) especially on snaps, Zips or leatherette elements
Attache / Fermoirs des anses attachées
Hole in the web


Labor costs and damage attributable to work performed by third parties other than VALTEX or any repairer authorized by us are not covered by the Cabaïa Commercial Guarantee.

What are the cases of exclusion of the Cabaïa Commercial Guarantee?

The Cabaïa Commercial Guarantee applies only to normal use of the product in accordance with its intended purpose. The following are not considered normal use of the product :
Loading a backpack with a weight of more than 25 kg, Carrying inappropriate objects (sharp, hot/cold objects, animals or other), Prolonged exposure of the product to significant hot or cold temperatures (below 0 degrees Celsius or above 50 degrees),
Exposure to abrasive products and surfaces as well as solvents, acids, water....

The Cabaïa Commercial Guarantee will also not apply in any of the following cases
Normal wear and tear of the product,
Of voluntary degradation,
Damage during transport in inappropriate conditions (in this case, you should contact the transport company),
Defects resulting from maintenance or repairs within the scope of the Cabaïa Commercial Guarantee carried out by third parties other than VALTEX or any repairer approved by us. Repairs not covered by the Cabaïa Commercial Guarantee may be carried out by any third party of your choice. Repairs falling within the scope of the Cabaïa Commercial Guarantee must be carried out by VALTEX or any repairer approved by us, failing which you may no longer avail yourself of the Cabaïa Commercial Guarantee.

The Commercial Guarantee is limited to the price of the product concerned, and does not cover consequential damages. In the event of a replacement, an equivalent or similar product is offered at least equal in value to the price paid for the item under which the Commercial Guarantee is implemented.

What is the territorial scope of the Cabaïa Commercial Guarantee?

The Cabaïa Commercial Guarantee applies to all purchases of Cabaïa products made in metropolitan France, subject to the above conditions.

2.  Legal guarantees

The Cabaïa Commercial Guarantee, where applicable, applies without prejudice to your right to benefit from the legal guarantee of conformity, under the conditions provided for in Chapter VII of Title I of Book II of the French Consumer Code, and that relating to latent defects, under the conditions provided for in Articles 1641 to 1649 of the French Civil Code.

Any request formulated under the legal guarantees must be addressed by registered letter with acknowledgement of receipt (LRAR) to the head office of VALTEX - 7 Cité Paradis 75010 Paris.

The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in case of a defect of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

Where the contract of sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal warranty is applicable to that digital content or digital service throughout the period of supply provided. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or service and not the date of its appearance.

The legal guarantee of conformity implies an obligation for the professional, if necessary, to provide all the updates necessary to maintain the conformity of the good.

The legal guarantee of conformity gives the consumer the right to repair or replace the good within thirty days of his request, without charge and without major inconvenience to him.

If the good is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests the repair of the good, but the seller imposes the replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the good.

The consumer may obtain a reduction in the purchase price by retaining the goods or terminate the contract by obtaining a full refund in exchange for the return of the goods, if :

1° The trader refuses to repair or replace the property;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the good causes a major inconvenience to the consumer, in particular when the consumer definitively bears the cost of taking back or removing the non-conforming good, or if the consumer bears the cost of installing the repaired or replaced good;
4° The non-conformity of the property persists despite the seller's unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious as to justify immediate reduction in price or rescission of the contract. The consumer is then not obliged to ask for the repair or replacement of the goods beforehand.

The consumer is not entitled to rescind the sale if the lack of conformity is minor.

Any period of immobilization of the good for its repair or replacement suspends the guarantee which remained to run until the delivery of the good restored.

The above-mentioned rights result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.

A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal guarantee of hidden defects in application of articles 1641 to 1649 of the civil code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the good is kept or to a full refund against return of the good.

In case of confirmation by VALTEX of the assumption of responsibility for the good under the legal guarantee giving rise to the repair or replacement of the non-conforming product, you must return the product to VALTEX for its compliance by post - Colissimo, the said return to be carried out and paid for by the parties in accordance with the provisions of Articles L.217-4 et seq., D.217-1, L.241-6 et seq. In this respect, VALTEX will be obliged to reimburse you for the cost of sending the good to be brought into conformity within a period of fourteen days at the latest from the day on which you are informed that the good has been taken over under the legal guarantee. The amount due for this is automatically increased by 10% if the refund is made within fourteen days after this period, by 20% up to thirty days and by 50% thereafter.
